The Highland Woman – Terms & Conditions and Privacy Policy

These Terms & Conditions and Privacy Policy (together, the “Terms”) apply to all use of The Highland Woman website, app, and related services, including all memberships, listings, and Brand Partnerships.

By creating an account, purchasing any package via our app, or using our website, app, or services, you confirm that you have read, understood, and agree to be bound by these Terms.
If you do not agree, you must not use our website, app, or services.


1. Packages, Memberships, Eligibility & Community Focus

We currently offer the following packages (all prices in AUD):

1.1 Members (Club Membership)

  • $30 per month, or
  • $360 per year.

The Highland Woman Club is a community‑based membership designed for women who identify with and support our vision of amplifying women’s voices, experiences, and businesses.
Membership is intended for individuals who identify as female and wish to participate in a women‑centred community.

1.2 Get Listed – Directory Only

  • $220 per year.
  • Includes a business/brand listing in The Highland Woman directory.
  • Does not include Club Membership benefits.

The directory is inclusive of a diverse range of service providers and businesses. Eligibility is based on alignment with our values and content standards, not gender.

1.3 Get Listed + Membership

  • $480 per year.
  • Includes:
    • Full Club Membership benefits; and
    • Directory listing as described for Get Listed.

1.4 Brand Partnership – Gold

  • $1,320 per year.

Gold Brand Partnership is designed for women‑led brands and businesses that align with the ethos and community focus of The Highland Woman. Details are set out in the app and on our website and may include:

  • Premium or featured directory placement;
  • Co‑marketing and promotional opportunities;
  • Access to selected events, collaborations, or activations.

1.5 Brand Partnership – Diamond

  • $2,200 per year.

Diamond includes everything in the Gold Brand Partnership, plus content created by The Highland Woman for your brand, as described in the Diamond package at the time of purchase (for example: editorial features, social media content, or other agreed formats).


1.6 Eligibility & Approval

  • Club Membership and Brand Partnerships are curated to support a women‑centred network and storytelling space. Applications are assessed for alignment with this focus, our values, and community guidelines.
  • The Get Listed directory is open to a broader range of businesses that align with our standards and values, regardless of the owner’s gender identity.

We may request information to help us assess alignment with our mission and community guidelines.

All memberships, listings, and partnerships are subject to approval. We may refuse, suspend, or cancel any package if:

  • you breach these Terms;
  • your conduct or content is inconsistent with our values, mission, or community guidelines; or
  • we reasonably believe your participation may harm our community or reputation.

All memberships, listings, and partnerships are personal to you/your businessnon‑transferable, and may not be sold or shared.

You must be at least 18 years old to purchase a package or become a member, unless otherwise agreed in writing with appropriate parental/guardian consent (see Section 9).


2. Benefits

Benefits vary by package and are described in the app and on our website at the time of purchase.

2.1 Club Membership

May include:

  • Access to member‑only content, resources, and online spaces.
  • Invitations to events, workshops, and networking opportunities.
  • Access to member‑only offers, discounts, and curated recommendations.

2.2 Get Listed – Directory Only

May include:

  • Inclusion of your business/brand in The Highland Woman directory in the category/format described at purchase.
  • Visibility to our community and directory visitors.
  • No Club Membership benefits unless separately purchased.

2.3 Get Listed + Club Membership

  • All benefits of Get Listed – Directory Only, plus all Club Membership benefits.

2.4 Brand Partnership – Gold

As described in the Gold package, may include:

  • Premium directory placement and/or featured listing;
  • Co‑marketing and promotion, such as inclusion in newsletters, app features, or social media, subject to editorial discretion;
  • Invitations and access to selected events, collaborations, or activations.

2.5 Brand Partnership – Diamond

Diamond includes all Gold Brand Partnership benefits, plus:

  • Content created by The Highland Woman for your brand (e.g. features, interviews, editorial pieces, social content or campaigns), in the formats and approximate volumes set out in the Diamond package description.

All partner content (Gold and Diamond) is:

  • Subject to editorial discretion – we retain full control over style, angle, wording, imagery selection, placement, and whether content is ultimately published or re‑used;
  • Subject to our brand and community guidelines – we may request changes to supplied information or decline content that does not align with our values, standards, or audience expectations.

We cannot guarantee that any particular piece of content will appear in a specific publication, channel, or format unless expressly agreed in writing.


3. Publication Timing for Brand Partner Content

Due to the organic nature of editorial and social media content:

  • We cannot commit to exact publication dates or times for Brand Partner content.
  • Content will be scheduled and published at suitable times determined by our editorial team, taking into account overall content planning, community relevance, and platform performance.
  • Unless otherwise agreed in writing, Brand Partnership content included in your annual Gold or Diamond package will be delivered and published over the course of the 12‑month package term, not all at once.

We will use reasonable efforts to deliver the agreed content volume during the package term, but timing and sequencing remain at our editorial discretion.


4. Payment, Renewal & Cancellation

4.1 Payment via App

  • All payments are processed through our app using supported payment methods (e.g. Apple App Store, Google Play, or other in‑app providers).
  • By confirming a purchase, you authorise the relevant app store or payment provider to charge you the price shown for the chosen package and billing period.
  • We do not store full card details; payment processing is handled by secure third‑party providers.

If a payment is declined or reversed, we may suspend or terminate access to your package until payment is completed.

4.2 Billing & Auto‑Renewal

  • Monthly and annual packages are billed in advance.
  • Unless clearly stated otherwise at purchase, packages are set to auto‑renew at the end of each billing period at the then‑current price.
  • You authorise recurring charges until you manage or cancel your subscription via the app store or in‑app subscription settings.

If pricing changes materially, we will notify you where required (for example, via the app or app store). Continued subscription after the change takes effect constitutes acceptance of the new price.

4.3 Managing & Cancelling Subscriptions

Because payments run through app stores:

  • You must manage and cancel subscriptions via your app store account settings (e.g. Apple ID Subscriptions, Google Play Subscriptions) or via any subscription‑management area within our app.
  • If you cancel:
    • Your access continues until the end of the current paid period;
    • Your subscription will not renew after that period.

We do not provide refunds for unused portions of a billing period, except where required by law or explicitly stated at the time of purchase.

4.4 Our Right to Cancel or Suspend

We may cancel or suspend your package or access if:

  • you breach these Terms or community guidelines;
  • we reasonably suspect fraud, abuse, or unlawful activity;
  • you fail to pay applicable fees; or
  • we discontinue or materially change a package or service.

If we cancel without cause (not due to your breach), we may, at our discretion and subject to app store rules, provide a pro‑rata refund of any prepaid, unused portion of your current billing period.


5. Conduct & Community Standards

By using our platforms or attending our events, you agree to:

  • Treat others with respect and professionalism;
  • Not engage in harassment, discrimination, bullying, defamation, or unlawful conduct;
  • Respect the women‑centred nature of our community and its values;
  • Comply with any event‑specific rules or codes of conduct.

We may restrict, suspend, or terminate access to our services, events, or platforms where, in our reasonable opinion, your behaviour is inappropriate, unsafe, harmful, or damaging to our community or reputation. No refund is owed where termination results from your breach of these Terms.


6. Intellectual Property & Content

All content on our website, app, and platforms (including text, images, video, audio, graphics, logos, and trademarks) is owned by or licensed to The Highland Woman.

You must not:

  • Copy, reproduce, distribute, adapt, or create derivative works from our content without written permission;
  • Use our name, logo, or trademarks in a way that implies endorsement or partnership, unless you are an approved Brand Partner and follow our brand guidelines.

6.1 Content You Provide

If you provide or upload content (e.g. directory information, images, testimonials, posts, brand assets):

  • You grant us a non‑exclusive, worldwide, royalty‑free licence to use, reproduce, adapt, publish, and display that content in connection with our services, our platforms, and our marketing, in accordance with applicable law and this Privacy Policy.
  • You confirm you have all necessary rights and permissions and that your content does not infringe third‑party rights.

6.2 Content We Create for Brand Partners

For content we create as part of Brand Partnerships (including Diamond):

  • Unless otherwise agreed in writing, we retain ownership of the content;
  • We grant you a licence to use that content for your own business promotion, subject to any usage terms we specify (for example, attribution, tagging, and non‑misleading use);
  • We may also use that content across our own platforms and marketing as we see fit.

All such content is created and published at our editorial discretion, including decisions on whether, when, and where it appears.


7. Privacy & Data Handling

We are committed to protecting your privacy. This section summarises how we collect, use, and disclose personal information.

7.1 Data We Collect

We may collect:

  • Contact details – name, email, phone, postal address;
  • Profile/demographic information – age range, location, interests, preferences;
  • Business/brand details – business name, description, services, logos, images, links;
  • Account and usage data – package type, purchase history, interactions with our app/website, log‑ins;
  • Event information – registrations, attendance, preferences, dietary or accessibility requirements (where provided);
  • Payment‑related data – handled by secure providers (not full card details on our servers);
  • Sensitive information – only if necessary (e.g. event accessibility needs) and only with your consent or as permitted by law.

7.2 How We Use Your Data

We use personal information to:

  • Process and manage memberships, listings, and partnerships;
  • Run and improve our website, app, and services;
  • Provide features, events, and benefits associated with your package;
  • Communicate with you about your account, services, and (where permitted) marketing;
  • Personalise content and recommendations;
  • Comply with legal obligations and protect our rights and community.

We only process personal information where we have a lawful basis (e.g. contract performance, consent, legal obligation, or our legitimate interests).

7.3 Disclosure of Your Information

We may share information with:

  • Service providers (hosting, analytics, payment processors, email, CRM);
  • Event partners and collaborators (where necessary to deliver events or benefits);
  • Professional advisers (legal, accounting);
  • Law enforcement or regulators (where required by law or to protect rights and safety);
  • Overseas service providers where our infrastructure is hosted or supported internationally. We take reasonable steps to ensure compliance with relevant privacy laws.

We do not sell your personal data.

7.4 Security

We use reasonable technical and organisational measures to protect personal information from misuse, interference, loss, and unauthorised access, modification, or disclosure.
However, no system is fully secure; use of our website, app, and email is at your own risk.

7.5 Your Rights

Subject to applicable law, you may be able to:

  • Access personal information we hold about you;
  • Request correction of inaccurate or incomplete information;
  • Request deletion or restriction of processing in certain circumstances;
  • Object to certain processing, including direct marketing;
  • Withdraw consent where processing relies on consent.

Contact us (Section 12) to exercise these rights. We may need to verify your identity.

7.6 Retention

We keep personal information only as long as necessary to:

  • Provide services and manage your relationship; and
  • Meet legal, accounting, and reporting requirements.

When information is no longer needed, we will take reasonable steps to securely destroy or de‑identify it.

7.7 Legal Compliance

We comply with applicable privacy laws where we operate, including, where relevant:

  • The Privacy Act 1988 (Cth) and Australian Privacy Principles; and
  • Any other local privacy and data‑protection laws that apply.

8. Marketing Communications

We may send you communications about:

  • Events, workshops, and community activities;
  • Membership/package updates and news;
  • Offers and promotions from us or selected partners.

You can opt out of marketing emails at any time using the unsubscribe link or via your communication preferences in the app (if available).
We will still send essential service messages (e.g. payment confirmations, important service or Terms updates).


9. Disclaimers & Limitation of Liability

9.1 Listings, Partners & Third‑Party Content

  • We do not independently verify all claims, profiles, or representations made by members, listed businesses, or Brand Partners; each is responsible for its own information.
  • Any products, services, or offers from a listed business, Brand Partner, or third party are their sole responsibility. We do not guarantee their quality, legality, or suitability.

9.2 Activity Outside Our Platforms

We are not responsible for:

  • Interactions, communications, or transactions that occur outside our official website, app, or events, even if parties first connected through our platforms.

You remain responsible for your own due diligence before engaging with any other member, listed business, or partner.

9.3 No Guarantee of Outcomes

We do not guarantee:

  • Any particular level of visibility, sales, or business growth from listings or Brand Partnerships;
  • Any personal, professional, or financial outcomes from membership or community participation.

9.4 Limitation of Liability

To the fullest extent permitted by law:

  • The Highland Woman and its directors, officers, employees, contractors, and agents exclude all liability for any loss, damage, cost, or expense (including indirect, consequential, special loss, loss of profit, or loss of opportunity) arising from or in connection with:
    • your use of, or inability to use, our website, app, or services;
    • reliance on any directory listing, partner information, or third‑party content;
    • any product, service, or conduct of a member, listed business, Brand Partner, or third party;
    • any arrangement or relationship formed outside our official channels.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited (e.g. certain consumer guarantees or liability for personal injury caused by our negligence).

Where our liability cannot be excluded, it is limited, to the maximum extent permitted by law, to:

  • the total fees you paid to us in the 12 months before the event giving rise to the claim; or
  • any minimum amount required by law,

whichever is greater.


10. Minors

Our services are primarily for adults:

  • Persons under 18 must have parental or guardian consent to create an account, become a member, or appear in a listing.
  • We do not knowingly collect personal data from children under 13. If you believe we hold such information, contact us so we can investigate and, where appropriate, delete it.

11. Compliance & Legal Requests

We may retain and disclose information where we reasonably believe it is necessary to:

  • Comply with laws, regulations, court orders, or law‑enforcement requests;
  • Protect our rights, property, or safety, or that of our users, partners, or the public;
  • Detect, prevent, or address fraud, security, or technical issues.

12. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be posted on our website and/or app with a new “Last updated” date and will take effect from the date of publication, unless stated otherwise.

Your continued use of our website, app, or services, or continued subscription after the updated Terms take effect constitutes acceptance of them. If you do not agree, you must stop using our services and cancel your subscription via the app store.

14. Agreement at Sign‑Up & Use of Services

By:

  • creating an account on our app or website;
  • purchasing any package (Member, Get Listed, Get Listed + Membership, Gold, or Diamond) via the app;
  • clicking “I agree”, “Accept”, or similar; or
  • using our website, app, or services,

you confirm that you:

  • have read, understood, and agree to these Terms & Conditions and Privacy Policy; and
  • have authority to enter into this agreement (and, where applicable, to bind your business or organisation).
